Electronic Funds Transfer Act (EFTA)
Your liability under federal law concerning unauthorized use of your ATM or CheckCard depends on how quickly you report the loss.
If you report your ATM/CheckCard missing before it is used without your permission, the EFTA states the card issuer cannot hold you responsible for any unauthorized transfers.
If you report your ATM/CheckCard missing within two business days, you will not be held responsible for more than $50 of the unauthorized use.
If you report your ATM/CheckCard missing after the two day period, you may lose up to $500 because of an unauthorized use.
If you do not report your ATM/CheckCard missing within 60 days of your first bank statement showing unauthorized usage, you could risk unlimited loss. You could lose all the funds in your account and any unused funds from any account linked to Overdraft Protection.
For unauthorized transfers using only your CheckCard number, not the card, you are only liable for transfers that occur after 60 days from the time your bank issues the statement reflecting the unauthorized use and before you report it.
